Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the Letters of the 1st Respondent in Ref.Lr.No.VII(2)/09585/2010 dated 12.04.2010 and the letter of the 2nd Respondent in Ex.XI(4)/22855/09 dated 21.04.2010 and quash the same and consequently direct the Respondents to change the Date of Birth of the petitioner as 01.03.1985 instead of 01.03.1986 in her B.Sc., Nursing Degree Certificate and Mark Sheets.

O R D E R

The grievances of the writ petitioner is that her date of birth has been erroneously entered in the B.Sc., Nursing Degree Certificate. The actual date of birth of the petitioner is 01.03.1985 and it was erroneously entered as 01.03.1986.

2. In this regard, the petitioner submitted an application before the respondent/authority, correcting the date of birth and the said application was not considered on the ground that the degree certificate has already been issued and therefore, the request cannot be complied with.

3. The counter filed by the respondents in the present writ petition reveals that there is a procedure to entertain the application for effecting such correction in the certificates. It is further stated that that the petitioner has not approached the respondent / University with prescribed application and fees.

4. The learned counsel appearing on behalf of the respondents also reiterated that in the event of submitting an application along with the required fees, the case of the petitioner will be considered for correcting the errors, if any occurred in the original certificate.

5. In view of the stand taken by the respondents, the petitioner is at liberty to submit a fresh application in the prescribed format along with all necessary fees and in the event of submitting any such application within a period of four weeks from the date of receipt of a copy of this order, the respondents shall consider the same and take a decision and pass appropriate orders as expeditiously as possible and preferably within a period of twelve weeks from the date of receipt of a copy of the application from the petitioner.

6. With these directions, the writ petition stands disposed of. No costs.
