ORDER
The application on hand has been instituted to direct the Hon'ble Administrator of the TNEWF not to conduct election for the so-called branches listed under Schedule D and E as mentioned in letter came through Whatsapp and more fully mentioned in the Annexure.
2. Two suits have been instituted in C.S.No.146 of 2024 and O.S.No.2934 of 2024 (transferred and renumbered as Tr.C.S.No.241 of 2024).
3. The Hon'ble Administrator appointed by this Court is in the process of conducting the election. It is not in dispute between the parties that the election process has already commenced. The applicants have already submitted an objection for conduct of election with regard to Schedule D and E. It is for the Hon'ble Administrator to look into the objection and take a decision and proceed with the election by following the due process. Once the process of election commenced, it is not preferable for this Court to stall the election process for constituting a democratic body. If any grievance exist, the same is to be redressed by way of election petition and in the manner known to law.
4. That being the principles to be followed, this Court is not inclined to entertain the application now preferred. The parties are at liberty to participate in the process of election to be conducted by the Hon'ble Administrator of the Federation and the election ought to be concluded as per the schedule already notified. Rest of the issues can be adjudicated in the pending suit.
5. Accordingly, the Application No.214 of 2025 stands dismissed. 17-01-2025 GD
