O R D E R

(The case has been heard through video conference) The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(c), 20(b)ii(B), Narcotic Drugs and Psychotropic Substances Act 1985 and 120-B of Indian Penal Code, in Crime No.2239 of 2020, seeks anticipatory bail.

2. Totally there are three accused in this case and the petitioner herein is A3. It is alleged the petitioner was found in possession of 4 kgs of Ganja. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is in noway connected with the alleged offence and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that A1 and A2 in this case have been arrested and based on the confession statement give by them this petitioner has been implicated. He would further submit that the custodial interrogation of the petitioner is necessary to the case. Hence, he prays for dismissal of this petition.

5. Considering the facts of the case and the petitioner was in possession of huge quantity (5 kgs) of contraband, this Court is not inclined to grant anticipatory bail to the petitioner.
