Respondent Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus, calling for the records of the respondent Bank dated 29.05.2015 in F.No.IOB/0079/92/2015-16 and as well as the consequential demand notice dated 18.09.2015 in F.No.IOB/0079/2015-16 and quash the same and further direct the respondent Bank to release all the petitioner's original documents deposited to the respondent Bank for availing the Term Loan in loan account No.270300002.

ORDER

Learned counsel for the petitioner submitted that the matter has been settled before the Mediation and Conciliation Centre attached to this Court.

2. Since the parties have arrived at an amicable settlement before the Mediation and Conciliation Centre attached to this Court and they have also filed a compromise memo dated 9.1.2019 agreeing to the following terms, (i)The issues in above writ petition will be resolved fully and finally by the payment of Rs.18,00,000/- (Rupees Eighteen Lakhs) by the respondent to the petitioner by deposit of the said amount in the SB A/c No.23665 of the petitioner at Indian Overseas Bank, RS Puram Branch, Coimbatore and there is no further claim against the bank. https://hcservices.ecourts.gov.in/hcservices/

(ii)The shares of the two sons of the petitioner will then be paid by her.

(iii)The said amount will be paid in the above said manner by the respondent to the petitioner by 31st March 2019.", the writ petition stands disposed of, as per the terms of compromise entered into between the parties. Since the loan account no.270300002 has already been closed, the respondent Bank shall return the documents which were received as security to the petitioner. Consequently, W.M.P.No.10674 of 2016 is closed. No costs.
