JUDGMENT

The matter is listed under the caption "for dismissal", today. The learned counsel for the appellant submits that the appellant is dead and he seeks time to take steps to bring on record the Legal Representatives for the deceased appellant. The Second Appeal is of the year 2007. Even on the last occasion i.e. on 04.09.2019, there was no representation on the side of the appellant. As seen from the earlier proceedings, this Second Appeal was dismissed for non prosecution on 04.06.2014 and subsequently restored on 03.09.2014. Therefore, it can now be inferred that the appellant is not interested to prosecute the Second Appeal. Accordingly, the Second Appeal is dismissed for non prosecution. No costs. Consequently, connected miscellaneous petition is closed.
