mtl 2.It is seen from the records that the sole appellant and the first respondent are no more and the respondents have not been served with notice in the petitions filed to implead their legal heirs. The Second Appeal is of the year 2009 and hence, I do not find any reason to keep the appeal pending.

3. In view of the same, this Second Appeal is dismissed for non prosecution. No costs. Consequently, connected miscellaneous petition is closed.
