O R D E R

The petitioner is a doctor and she has approached for transfer of H.M.O.P. No.86 of 2019 from the file of Sub Court, Palladam to the file of Sub Court, Poonamallee.

2. Learned counsel appearing for the respondent submitted that, instead of Sub Court, Poonamallee, the matter may be heard at Chennai, in any one of the Family Courts and that he has no objection for the petitioner being represented by a lawyer. It is needless to mention that the petitioner can also be represented by a lawyer, as she is a professional and she cannot be expected to appear in all the hearings.

3. Taking note of the submissions of both parties and in the light of section 24 of the Civil Procedure Code, instead of transferring H.M.O.P. No.86 of 2019 from Sub Court, Palladam to Sub Court, Poonamallee, the matter is transferred to the Family Court, Chennai, for trial. The Family Court, Chennai is expected to conclude the trial, as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order, without adjourning the matter beyond 45 working days, at any point of time, in order to bring the issue to a logical end.

4. The Transfer Civil Miscellaneous Petition is ordered as indicated above. No costs. Consequently, the connected Civil Miscellaneous Petition is closed.
