ORDER

This petition has been filed seeking a direction to the respondents to regularize the annual increments of the Petitioner from the month of May 2015

to till the date of his retirement on 30.06.2025 and the pay the arrears with 10 percentage interest by considering the fact of closure of disciplinary proceedings against him.

It is the case of the petitioner that the petitioner was appointed as Driver in the respondent Transport Corporation in the year 2001 and he was suspended from service on 14.04.2015 alleging that he became responsible for the seizer of 180 litre liquor from a hut opposite to the petitioner's house resulting in the arrest of him by the officials under Tamil Nadu Prohibition Act. Pending disciplinary proceedings, suspension order was revoked by the respondents on 25.04.2015. Due to pendency of the disciplinary proceedings, the annual increments was stopped in May 2015 and also in the subsequent years. On attaining the age of superannuation, the petitioner retired from service on 30.06.2025 without getting the regularization of his pay effective from May 2015 till the date of his retirement on 30.06.2025 and the same is not considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Standing Counsel appearing for the respondent submitted

that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the second respondent to consider and pass orders on the petitioner's representation dated 30.06.2025 within a period of four weeks from the date of receipt of a copy of this order.
