ORDER

This writ petition has been filed, challenging the impugned proceedings of the second respondent dated 30.10.2023, recommending the grant of patta in favour of the third respondent.

2. The learned counsel for the petitioner would contend that till date, no patta has been issued in favour of the third respondent pursuant to the impugned proceedings of the second respondent dated 30.10.2023, recommending the grant of patta in favour of the third respondent. The petitioner claims that the third respondent is not entitled for grant of patta in his name. She has raised several objections in this writ petition.

3. If patta has already been issued in favour of the third respondent for the subject property, the petitioner will have to seek for cancellation of the same in accordance with law. Only if the patta has not been issued till date, pursuant to the impugned proceedings of the second respondent dated 30.10.2023, a limited relief can be granted by this Court to enable the petitioner to raise all objections before the official respondents, with regard to the grant of patta in favour of the third respondent pursuant to the impugned proceedings of the second respondent dated 30.10.2023.

For the foregoing reasons, this Court directs the petitioner to raise all objections with regard to the proceedings dated 30.10.2023 of the second respondent, recommending the grant of patta in favour of the third respondent before the first respondent. The petitioner is directed to submit written objections to the first respondent within a period of two weeks from the date of receipt of a copy of this order. If the respondents 1 and 2 have not already

issued patta in favour of the third respondent, pursuant to the impugned proceedings of the second respondent dated 30.10.2023, the respondents 1 and 2 shall intimate the same to the petitioner and consider the petitioner's objections if received within the stipulated time and thereafter, pass final orders on merits and in accordance with law with regard to the issuance of patta for the subject property in favour of the third respondent as expeditiously as possible.

5. Accordingly, this writ petition is disposed of. No Costs.
