This Second Appeal has been filed to set aside the judgment and decree dated 24.07.2008 made in A.S.No.16 of 2005 on the file of the District Judge, Thiruvannamalai in confirming the judgment and decree dated 28.02.2005 made in O.S.No.39/99 on the file of the Principal Sub Judge, Thiruvannamalai.

2. The learned counsel for the appellant seeks permission of this Court to withdraw this Second Appeal and also made the following endorsement:
