The Second Appeal had been filed by the plaintiff in O.S.No.8 of 2004 on the file of the District Munsif Cum Judicial Magistrate, Portonovo, Cuddalore District. The Suit had been filed seeking preliminary decree for partition and separate possession. The Suit had been dismissed. The appellant herein then filed A.S.No.33 of 2007 before the Sub Court, Chidambaram. The Appeal Suit had also been dismissed. The Second Appeal had then been filed. The Second Appeal had not yet been admitted. 2.It is now informed by the learned counsel for the appellant that the appellant had died and there is no response even though notice had been sent to the legal representatives. It is obvious that the appellant / legal representatives are not interested in prosecuting the Second Appeal any further. The Second Appeal stands dismissed as abated.
