JUDGMENT

The learned counsel for the appellant submits that the appellant is a tenant and has suffered a decree of eviction passed in favour of the respondent, which has been confirmed by the Lower Appellate Court and the present Second Appeal has been filed challenging the concurrent findings of the Courts below. The learned counsel for the appellant on instructions would submit that subsequent to the passing of the decree against the appellant, the respondents have also taken possession of the property from the Appellant. Hence nothing survives for adjudication in this Second Appeal. The same is recorded by this Court and the Second Appeal is closed. No costs. Consequently, connected miscellaneous petition is closed.
