Petition seeking bail in respect of Crime No.1352 of 2024 registered for the offences punishable under Sections 296(b), 309(5)(6) and 351(2) of BNS, is on board for consideration.

2. The incarceration of the petitioners/A1 & A2 being from 23.12.2024 pleading innocence on the part of the petitioner and false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He also submits that the petitioners are in no way connected with the alleged offence and they are ready to abide by any stringent condition that may be imposed by this court. https://www.mhc.tn.gov.in/judis

3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the accused had waylaid the de facto complainant, abused him in filthy language, assaulted him and attempted to snatch his mobile phone. He also submits that the case is under investigation and further submitted that both the petitioners are habitual offenders and against them, 9 previous cases are pending

4. Having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and considering the antecedents of the petitioner, this court is not inclined to grant bail to the petitioner.

5. Accordingly, the Criminal Original Petition stands dismissed for the present.
