There is no representation for the petitioner either in-person or through his counsel.

However, Mr.Niranjan Rajagopalan, learned counsel for the respondent submitted that the terminal benefits have been settled to the petitioner on 03.05.2021 itself. In para 3 of the counter, it is stated as under:- "At the outset, I humbly submit that the present Writ has been filed by the petitioner during January 2021, with a prayer to direct the Respondent Port to grant maximum pension and settlement of all the terminal benefits including gratuity, eligible to the petitioner herein. However, this Respondent Port has already settled the Pension (PPO No.17911), Pension arrears, commutation payments and Gratuity to the Petitioner on 03/05/2021 though the petitioner herein had not cooperated with the administration, delayed in submission of pension related documents and changing his stand in nominating his wife. The details of the settlement are as follows:- (A) Commutation - Rs.7,44,260/- (B) Total Gratuity - Rs.7,35,970/- 2/5

(Recovery from Gratuity: Rs.7,35,470/-, Net Gratuity Rs.500/-) (C) Pension Arrears amount: Rs.1,50,652/- (D) GPF amount: Rs.1,30,249/- (Adjusted towards Society recovery) (E) EL Encashment: Rs.2,25,370/- (Adjusted towards Society recovery) (F) FSS amount: Rs.4,900/- Therefore, I humbly submit that, as on date the above Writ Petition has become infructuous and liable to be dismissed, as the Respondent Port had already settled the entire settlement alongwith pension and Pension arrears amount on 03.05.2021 to the petitioner herein."

Since the relief sought by the petitioner has already been granted to him, this petition has become infructuous. 4.

Hence, this Writ Petition is dismissed as infructuous. No costs.
