C.M.P.Nos.501, 502 and 483 of 2015 in S.A.No.963 of 2005 P.R.SHIVAKUMAR.J., Heard both sides.

2. The first appellant Narayanasamy Naidu has been reported dead. Though the petition to implead his legal representatives came to be filed in C.M.P.No.483 of 2015, due to absence of proper advice, the petitioners did not file petition to set aside abatement and petition to condone the delay in filing the set aside abatement petition. The said petitions have been filed subsequently. The learned counsel for the respondents submits that the respondents do not have objection for allowing the petitions provided they are compensated with costs.

3. The said representation is recorded and all the petitions are allowed. The petitioners shall pay a sum of Rs.5,000/- as costs to the respondents. The Registry shall carry out the necessary corrections in the cause title and list the matter for hearing on 16.10.2015. 14.10.2015 gpa
