PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to call for the records and quash the complaint filed under the Domestic Violence Act in DVOP No.105 of 2014 on the file of the Judicial Magistrate No.II, Additional Mahila Court, Salem. For Petitioner : Mr.Saikrishnan For Respondent : Mr.J.Saravnavel

ORDER

This petition has been filed challenging the Domestic Violence proceedings initiated by the respondent.

2. This petition was not even entertained by this Court and it is kept pending from the year 2015 onwards. Necessary allegations have been made in the petition and the first petitioner, who is the husband has to go before the Court below and establish his defence. This Court is not inclined to interfere with the proceedings at this stage.

3. In the result, this Criminal Original Petition is dismissed and the Court below is directed to complete the proceedings in DVOP No.105 of 2014 on the file of the https://hcservices.ecourts.gov.in/hcservices/

Judicial Magistrate, Additional Mahila Court, Salem within a period of three months from the date of receipt of copy of this order. The presence of the 2nd and 3rd petitioners are dispensed with and they shall be represented by a counsel before the Court below. Consequently, the connected miscellaneous petitions are closed.
