Heard Mr.R.Sreerangan, learned counsel appearing for the petitioner/proposed respondent, Mr.N.G.R.Prasad, learned counsel appearing for the first respondent/writ petitioner, Mr.K.V.Sajeev Kumar, learned Special Government Pleader appearing for the second respondent and Mr.P.Kumaresan, learned Additional Advocate General assisted by Mrs.P.Veena Suresh, learned Standing Counsel appearing for the respondents 3 & 4.

2. Although Mr.N.G.R.Prasad, learned counsel appearing for the first respondent/writ petitioner heavily opposed the prayer for impleadment, this Court, considering the fact that the impleading petitioner and the writ petitioner are the owners of their respective flats and also the co-owners of the Undivided Share of Land in Jeevan Bhima Nagar, Anna Nagar West Extension, finding prima facie case in favour of the implead petitioner that the land belonging to him has been utilized without leaving sufficient set 1/3

back space, is inclined to accept his prayer. Accordingly, W.M.P.No.1497 of 2022 in W.P.No.620 of 2022 is allowed and the proposed petitioner is impleaded as the party respondent in W.P.No.620 of 2022. (T.R.,J.) (S.S.,J.) 11.04.2022 Registry is directed to carryout the amendment forthwith ss 2/3
