The Second Appeal is filed under Section 100 of CPC against the judgment and decree dated 27.06.2006 made in A.S.No.2 of 2006 on the file of the Subordinate Court, Panruti reversing the appeal against the judgment and decree dated 19.09.2005 made in O.S.No.83 of 1997 on the file of the District Munsif Court, Panruti.

The second appeal has been filed as against the judgment and decree dated 27.06.2006 made in A.S.No.2 of 2006 on the file of the Subordinate Court, Panruti reversing the appeal against the judgment and decree dated 19.09.2005 made in O.S.No.83 of 1997 on the file of the District Munsif Court, Panruti.

2. The learned counsel for the appellants submitted that the both the appellants died, and he could not get any particular about the legal heirs of the deceased appellants. 3.It is seen that both the appellants died, however the legal heirs of the appellants have not taken steps to implead themselves as party in the second appeal, which shows that they are not interested in proceeding with the same. second appeal is liable to be dismissed as abated. 4.Accordingly, the second appeal is dismissed as abated. Consequently, connected miscellaneous petition is closed. No costs.
