CMP.Nos.1826, 1828 and 1831 of 2024 in SA.No.570 of 2013 V.LAKSHMINARAYANAN.J., These petitions have been filed praying (i) to condone the delay of 270 days in filing the petition to set aside the abatement caused due to the death of the deceased respondent namely Marathal in the above appeal, (ii) to set aside the abatement caused due to the death of the deceased respondent namely Marathal in the above appeal (iii) to permit the petitioners/appellants to bring on record the proposed respondents 4 to 6 herein as legal heirs of the deceased respondent namely Marathal in the above appeal and rank them as respondents 6 to 8 in the above appeal, respectively.

2.Heard Mr.K.Govi Ganesan, learned counsel for the petitioners/appellants.

3.Considering submissions made by the learned counsel for the petitioners/appellants and the reasons mentioned in the affidavits filed in support of the respective petitions, this Court feels it appropriate to allow these petitions.

V.LAKSHMINARAYANAN.J., dn 4.Accordingly, these C.M.Ps. are allowed. Registry is directed to carry out necessary amendments in the cause title and list the matter on 22.02.2024.

5.The learned counsel for the petitioners/appellants shall take steps in the Appeal for newly impleaded respondents.
