ORDER : The Court Made the following order :- The petitioner/A6 who was arrested and remanded to judicial custody on 22.09.2021 for the offences under Section 8(c), r/w 20(b) (ii)(C), 25 & 29(1) of NDPS Act 1985 in Cr.No.28 of 2021 on the file of the respondent police, seek bail.

2.The case of the prosecution is that the petitioners along with other accused were alleged to have involved in illegal possession of 60 Kgs of Ganja in 3 bags (each 20 Kgs) and the petitioners in both Crl.O.P.No.24602 and 24780 of 2021 were in possession of 50 Kgs of Ganja in 2 bags (each 25 Kgs). Totally 110 Kgs of ganja were seized from A1 to A6. Hence, the complaint.

3. The learned counsel appearing for the petitioner/A6 submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner have been suffering incarceration for more than 162 days. Hence, he prays for grant of bail to the petitioners.

4.The learned Government Advocate (Crl.Side) submitted that the petitioner and others are alleged to have involved in illegal possession of 110 Kgs of narcotic drug Ganja which is of commercial https://hcservices.ecourts.gov.in/hcservices/

quantity. He further submitted that there are four previous cases pending against the petitioner. Hence, he vehemently opposed to grant bail to the petitioners.

5. Considering the fact that the earlier bail application was dismissed and there is no change of circumstances, as of now, this court is not inclined to grant bail to the petitioner.
