The petitioners herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 318(3), 318(4) and 351(4) of BNS in Crime No.11 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioners is that the petitioner was engaged as auditor for filing GST returns of the defacto complainant and a sum of Rs.30,61,514.19/- was paid, however the petitioner herein has not filed the return and also not deposited the amount.

3. The learned counsel appearing for the petitioner submitted that the petitioner has promptly filed the details every period and the petitioner also paid the entire money into the GST account, however without verifying the same, present complaint has been lodged.

4. The learned Government Advocate (Crl. Side) submitted that investigation in this case is pending.

Considering the submission of both sides, I am of the view that the petitioners shall be given an opportunity to explain his case before the Investigation Officer and accordingly, 1st petitioner shall appear before the Investigation Officer everyday from 09.02.2025 to 16.02.2025 at 11.00.a.m., and the 2nd petitioner shall appear as and when required for the purpose of enquiry.

6. Post the matter on 17.02.2026. Till then, the respondent shall not arrest the petitioners. The respondent shall also file status report on that day. 29.01.2026 sma 3/4
