When the matter is taken up for hearing on 08.11.2008, the learned counsel for the appellant submitted that the appellant has disengaged him of his services, and that he had returned the case papers to the appellant. Hence, the matter was directed to be listed on 12.11.2018, under the caption "for dismissal".

2. Though the name of the appellant appears to be printed in the cause-list today, there is no representation for the appellant either in person or through counsel. Hence, this appeal is dismissed for default. No costs.
