This petition has been filed to condone the delay of 113 days in filing the Civil Miscellaneous Appeal.

2. Heard the learned counsel for the petitioner. Though notice was served, there is no appearance for the repsondents.

3. Considering the submissions made by the learned counsel for the petitioner, this Court is of the view that the delay may be condoned, however, on payment of cost. Accordingly, the delay is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) by the petitioner to the Madras High Court Legal Aid Services Authority, Chennai, within a period of two weeks from today.
