O R D E R

(The case has been heard through video conference) The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 379 and 430 IPC and 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No.751 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is said to have transported 1/2 unit of river sand illegally. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not indulged any offence as alleged by the prosecution and he has been falsely implicated in this case.

4. The learned Additional Public Prosecutor appearing for the State submitted that the petitioner is said to have transported 1/2 https://hcservices.ecourts.gov.in/hcservices/

unit of river sand illegally and that there are five previous cases pending against the petitioner. Hence, he strongly opposed to grant anticipatory bail.

5. Considering the fact that the petitioner is a habitual offender and that the petitioner has involved in five pending cases, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
