Today, the matter is listed under the caption "for Clarification", at the instance of the learned counsel for the respondent.

2. The learned counsel for the respondent submitted that the undertaking affidavit has been filed by the respondent and sought time for eight months to vacate the portion of the suit property.

3. The learned counsel for the appellant submitted that, the person who signed in the undertaking affidavit is not a party to the proceedings. Mr.S.Sivaprakasan, alone is the party represented by the Elite Traders.

4. The learned counsel for the respondent argued that Mr.S.M.K.Arul is also one of the partners of the Elite Traders who is the respondent in the appeal and gave undertaking to vacate the premises on or before 17.04.2024, and hence he prays to accept the undertaking filled by him. 1\2 https://www.mhc.tn.gov.in/judis

5. As per the undertaking of the affidavit filed by the respondent, eight months time is granted to vacate the premises on or before 17.04.2024.
