O R D E R
The present criminal original petition has been filed to direct the second respondent to register the petitioner's complaint dated 29.12.2015.
2. The petitioner herein lodged a complaint against her mother in law and father in law on the allegation of abuse, threat and assault made by them on account of dowry demand. Though the complaint was lodged on 29.12.2015, till date no action was taken on the said complaint. Hence, the present Criminal Original Petition has been filed.
3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 and 2.
4. When the matter is taken up for consideration, the https://hcservices.ecourts.gov.in/hcservices/
learned Additional Public Prosecutor submitted if a fresh complaint is given by the petitioner directly to the second respondent, necessary action will be taken.
5. Considering the submissions made on either side, this court directs the petitioner to give a fresh complaint along with a copy of this order to the second respondent within a period of one week from the date of receipt of a copy of this order. On receipt of such complaint, the second respondent is directed to conduct enquiry and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law, as early as possible. If no prima facie case is made out, the second respondent is directed to pass an appropriate order on the said complaint.
6. This criminal original petition is disposed of accordingly.
