ORDER
The petitioner has come up with a claim that the members of the Dalit Welfare Trust has been maintaining the public toilets as a licensee under the Chennai Corporation. When there was an attempt to
auction the privilege of maintaining the public toilets, the petitioner submitted a representation to the Chennai Corporation on 31.01.2014, to preserve the status-quo and permit its members to continue to maintain the public toilets. Since there was no follow up action, the petitioner has come up with this writ petition.
2. Heard the learned counsel for the petitioner and the learned Standing counsel on behalf of the Chennai Corporation.
3. The learned Standing counsel for the Chennai Corporation submitted that the Corporation has taken a decision to hold auction to part with the privilege to maintain the public toilets.
4. Even though the learned Standing counsel has made a submission that the Corporation has taken such a decision, there is nothing on record to show that the Corporation is in the process of auctioning the privilege to maintain the toilets.
5. The Commissioner, Corporation of Chennai, is directed to consider and dispose of the representation submitted by the petitioner dated 18.3.2014 on merits and as per law. Such exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.
