Writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 3rd respondent to consider the representation of the petitioner dated 30.01.2018 and consider the petitioner's name for temporary promotion by including his name in the list of persons for promotion for the Post of Line Inspector.

O R D E R

The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the 3rd respondent to consider the representation of the petitioner dated 30.01.2018 wherein the petitioner sought for promotion to the post of Line Inspector from the post of Wireman. 2.

Heard the learned Standing Counsel appearing for the respondents.

On the face of the records, this Court is of the view, that the prayer in the Writ Petition itself is wholly misconceived for the simple reason that when the name of the petitioner has been shown in Sl.No.104 in the Seniority List of Wiremen prepared on 31.05.2015, the petitioner could not make out a case that his juniors who are placed below Sl.No.104 have been given promotion. Therefore, without waiting for his turn, he cannot come to this Court by way of filing the Writ Petition.

In the result, the Writ Petition fails and the same is accordingly dismissed.

No costs.

Consequently, connected Miscellaneous Petition is also closed.
