ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2), 326(a) of BNS Act, in Crime No.148 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that while the respondent 1/4

police was on regular patrol found that the petitioner was illegally transported 2 units of morambu sand from Aalankuppam Lake in a lorry without any valid permit/licence. Hence the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he is ready and willing to abide by any conditions that may be imposed by this Court and ready to cooperate with the investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the investigation in this case is still pending. Hence, she opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); the nature of allegations, investigation of this case is still pending, and also the fact that the petitioner has illegally transported the lake sand which causing severe damage to the ecology and water body, this Court is not inclined to 2/4

grant anticipatory bail to the petitioner.
