This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of H.M.O.P. No.73 of 2025 pending on the file of the Principal Subordinate Court, Cheyyar, and transfer of the same to the Family Court at Chennai.
3.Marriage between the petitioner and the respondent was solemnized on 08.11.2024 at Sri Pachaiamman Mahal, Munugapattu, Tiruvannamalai. The respondent filed HMOP No.73 of 2025 seeking restitution of conjugal rights before the Principal Subordinate Court, Cheyyar. 4.The case of the petitioner wife is that she is residing at West Mambalam, Chennai along with aged parents. Further the petitioner is suffering from skin related aliments pain and the very object of the respondent is to harass her by compelling repeated travel. She is constrained to travel to Cheyyar for every hearing, that the transfer is sought on the ground of hardship.

Today, when the matter is taken up for hearing, there is no appearance for the respondent.

In the case on hand, the petitioner has shown sufficient cause regarding difficulty in attending the Court at Cheyyar and the request for transfer is found to be bonafide. Having regard to the petitioner's residence at Chennai and the nature of the proceeding, this Court is satisfied that the transfer sought is to be ordered.

Accordingly, Tr.C.M.P. No.73 of 2026 is allowed. H.M.O.P. No.73 of 2025 pending on the file of the Principal Subordinate Court, Cheyyar is withdrawn and transferred to the file of the Family Court, Chennai. The Principal Subordinate Court, Cheyyar shall transmit the entire records to the Family Court, Chennai within three weeks from the date of receipt of copy of this order and the Family Court, Chennai shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observation made in this order. No costs. Consequently, the connected miscellaneous petition is closed.
