ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.11.2025, for the offences punishable under Sections 5(1) 5(n) r/w 6(1) of the Prevention of Children from Sexual Offences Act, 2012 of POCSO Act in Crime No.50 of 2025, registered on the file of the respondent police, seeks bail.

2.The allegation against this petitioner who is a relative of the victim girl aged about 16 years is that he continuously stalked her and also threatened to share her nude photos. It is alleged that when the victim girl was alone taking advantage of the situation the petitioner committed aggravated sexual assault on her which resulted in pregnancy. When she informed the same to the family members they did not support her, hence the petitioner informed the incident to the Child Help Line. Hence, this case.

3.The learned counsel appearing for the petitioner submitted that investigation in this case is completed and the petitioner is in judicial custody for more than 80 days and he is ready to co-operate with the investigation. Hence, prays to grant bail.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that investigation in this case is completed and the case is not taken on file. Hence, opposed to grant bail to the petitioner.

5. I have gone through the statement recorded from the victim girl which reveals the manner in which the occurrence has taken place and now the family members of the victim girl are supporting her. 6.Considering the submissions made by the learned counsel appearing on either side, nature of offence and it is a case of aggravated penetrative sexual assault and if the petitioner is released on bail he will indulge in tampering of evidence, this Court is not inclined to grant bail to the petitioner.
