The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the respondent to settle the terminal benefits/arrears of settlement benefits of Rs.52,000/- and consequential pension benefits to the petitioner with interest at the rate of 6% p.a. by taking into consideration of his representation dated 01.02.2018. 2.

Learned Counsel for the petitioner submitted that the petitioner who was serving as a Superintendent in the respondent Corporation has retired from service on attaining the age of superannuation on 30.4.2015 and his terminal benefits were also settled except the benefits covered under 12(3) Settlement. Hence the present Writ Petition.

Heard Mr.R.P.Pratha Singh, learned Standing Counsel, who takes notice for the respondent.

On the face of the records, it appears that the writ petition has been filed without any details with regard to the non-payment of terminal benefits under 12(3) Settlement and not even a copy of the 12(3) Settlement has been filed. Though this Court finds that the

petitioner is unable to produce the copy of the 12(3) Settlement, at least, the petitioner could have mentioned the date on which the 12(3) Settlement was reached between the parties and the benefits mentioned therein and what benefits given in the settlement. Therefore, I find no merit in the writ petition. 5.

In the result, the Writ Petition fails and the same is accordingly dismissed. No costs.
