Mr.L.P.Shanmugasundaram, Special Govt.Pleader for R1 and R2 Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the first respondent to dispose the statutory revision filed u/s 153 of The Tamil Nadu Cooperative Societies Act 1983 by the petitioner on 15.07.2018 within a stipulated time as this Honourable Court may fix and pass such further orders as this Court may deem fit and proper in the circumstances of the case.

O R D E R

The petitioner, who was working as Clerk in the third respondent Society, attained superannuation on 31.05.2018. However, he was not allowed to retire but was relieved from service by an order dated 31.05.2018 of the second respondent. His retirement benefits were not disbursed on the ground that inspection under Section 82 of the Cooperative Socities Act was going on with respect to the loss sustained by the Society. 31.05.2018, the petitioner filed an appeal under Section 153 of the Tamil Nadu Cooperative Societies Act, before the first respondent on 15.07.2018 and the same was not considered till date. Hence, the present writ petition is filed.

2. Mr.L.P.Shanmugasundaram, learned Special Government Pleader takes notice on behalf of the respondents 1 and 2.

3. Considering the facts and circumstances of the case, without going into the merits of the matter, the first respondent is directed to consider the appeal filed by the petitioner dated 15.07.2018 and pass orders on merits and in accordance with law, after affording due opportunity to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order. The writ petition is disposed of in the above terms. No costs. Consequently, connected miscellaneous petition is closed.
