A memo dated 09.01.2019 had been filed by the learned counsel for the appellants. The memo reads as follows:- "It is most respectfully submitted that we are the counsel on record for the Appellant in the above second appeal. The case came up for hearing lastly on 12.12.2018, after which we contacted our client for instructions. At this point we were informed by our client that nothing survives in the above second appeal and the same can be withdrawn. However we requested our clients to give us a written confirmation to that effect, which is yet to be received by us. Hence it is most respectfully prayed that this Hon'ble Court may be pleased to record this memo and permit us to withdraw the above second appeal and render justice".
