2. Heard the learned counsel for the petitioner.

3. The learned counsel for the respondents No.1 & 2 has no objection in allowing this petition.

4. The petitioner would aver that due to administrative reasons, delay of 138 days occurred in preferring the civil miscellaneous appeal.

5. In consideration of the above said details and in order to render effective justice, this petition is ordered and the delay of 138 days is hereby condoned.
