Respondent Habeas Corpus Petition filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus, directing the respondent herein to produce body or the person of the detenu minor boy namely Abyshek Indhu Sukumar detained by his Grandfather, mother and other relatives detained at No.5/A2, Sri Krishna Nagar, Vivekananda Main Road, Kolathur, Chennai 600 099 before this Court to see the minor body namely Abyshek Indhu Sukumar immediately enabling the petitioner and relatives of the father of minor child.

ORDER

(Order of the Court was made by P.N.PRAKASH, J.) This petition has been filed seeking a direction to the respondent herein to produce the body or person of the detenu minor boy, namely Abyshek Indhu Sukumar detained by his Grandfather, mother and other relatives before this Court, thereby enabling the petitioner to see the minor boy.

2. On 23.09.2015, this Court passed the following order in M.P.No.1 of 2015:

"In the earlier hearing i.e. on 22.09.2015, the matter was ordered to be https://hcservices.ecourts.gov.in/hcservices/

posted under the caption "for dismissal", as there was no representation for the petitioner. Even today, there is no representation for the petitioner.

2. On the aforesaid circumstances, we are of the view that the petitioner is not interested in prosecuting the case. Hence, the petition is liable to be dismissed for non prosecution.

3. In the result, this petition is dismissed for non prosecution."

3. Today when the matter was called, there was no representation for the petitioner. May be the cause for which this petition has been filed does not survive at this moment and that is perhaps the reason why there is no representation for the petitioner. Hence, this Habeas Corpus Petition is closed.
