R.Daniel v. A.Sarath

2026-01-21Honourable Mr.Justice V. Lakshminarayanan3 pages

in W.P.No.49192 of 2025 V. LAKSHMINARAYANAN Mr.S.Baskar, counsel states that the proposed party had installed the Church, which is the subject matter of the writ petition 30 years ago. He pleads that in case any orders passed in the writ petition, his rights will be adversely affected. Hence, he seeks to come on record.

2. Mr.B.Kaarvannan, counsel for the first respondent opposes the impleading, stating that the petitioner has not stated how he has rights to the property, in which, he has constructed the Church.

3. Be that as it may, the test for impleading is whether an order can be passed against the person, who claims to be the owner of the property, without him being shown in the array of parties. As Mr.R.Daniel claims he has installed the Church and he has been praying therein, as a worshipper, he has standing to come on record.

4. I am convinced with the reasons stated in the affidavit, the impleading is ordered.

5. Registry is directed to carry out the amendment, the petitioner shall be arrayed as 3rd respondent in the writ petition and list the writ petition on 22.01.2026 in the admission list.
