S.A.No.277 of 2009 V. LAKSHMINARAYANAN, J, On 17.04.2023, it was pointed out to the learned counsel appearing for the appellants that the appeal has been abated but still Mr.Theeraj wanted time to enable him to take steps. On that date, it was specifically stated that the appeal is posted to 24.04.2023 so as to enable him to take steps, otherwise the appeal will be dismissed as abated.

2.Mr.Theeraj, learned counsel represents today that he attempted to contact the party but till date the parties had not got in touch with him.

Therefore, this appeal is dismissed as abated. Liberty is granted to the appellants to come forward with applications to condone the delay, to set aside the abatement and to bring on record the legal representatives of the deceased.
