This petition has been filed to relax the bail condition relating to the petitioner that he shall appear before the Trial Court once in six months, on the first working day of English Calendar month at 10.30 a.m., until further orders in Crl.M.P.No.15128 of 2022 in C.A.No.1102 of 2022 dated 12.10.2022.
2.The petitioner was convicted by the trial Court in C.C.No.15 of 2001, against which, he filed an appeal in Crl.A.No.1102 of 2022 before this Court. This Court, by an order dated 12.10.2022 in Crl.M.P.No.15128 of 2023 granted suspension of sentence directing the petitioner to appear before the trial Court, namely, Principal Special Judge for CBI Cases, VIII Additional City Civil Court, Chennai, once in six months, on the first working day of English Calendar month at 10.30 a.m. 1/3
3.The present petition has been filed seeking relaxation of the said condition for the reason that the petitioner is now aged more than 75 years and he is suffering from Cerebro Vascular Accident, Cervical Disc Disease with radiculopathy at C5-C6 level and taking medical treatment and he has been advised to take complete rest and physiotherapy at home. He is unable to move without the support of others. Hence, prayed for relaxation of the condition.
4.Heard the learned Special Public Prosecutor (CBI cases). 5.Considering the fact that the petitioner is aged more than 75 years and he is unable to move without the support of others, this Court is inclined to relax the condition.
6.Accordingly, the condition imposed on the petitioner to appear appear before the trial Court once in six months, on the first working day of English Calendar month at 10.30 a.m, is totally relaxed. All other conditions remain unaltered.
