This application has been filed seeking re-fund of Court fee of Rs.62,885/- paid inadvertently.

2. The appeal arises out of the award of the Tribunal at Puducherry. Therefore, the Court fee stamps at Puducherry should have been affixed. However, the learned counsel for the appellant had paid the Court fee meant for the state of Tamil Nadu. Thereafter, they have also paid the Court fee to the State of Puducherry and have come forward with this application for re-fund of Tamil Nadu Court fee.

3. Accepting the reasons assigned in the affidavit filed in support of the petition and in view of Section 70 of the Tamil Nadu Court Fees and Suits Valuation Act, this petition is ordered as prayed for.
