Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Certiorari, to call for the records of the 2rd respondent relating to the imputed order in Se.Mu.No. A3/1888/2024 dated 02.01.2025 and quash the same as illegal, void and thus render justice.

From a perusal of the original records it is seen that the petitioner has not been served with the notice of appearance by the 2nd respondent and without hearing the petitioner the impugned order has been passed. 2/5
2. It is also seen that the address to which the original notices have been sent is the address of the deceased Abdul Bari. The RDO's order however is addressed to the present address of the petitioner.
3. Therefore, it is clear that the impugned order has been passed without notice to the petitioner. In these circumstances, the order impugned cannot be sustained, therefore, the impugned order is quashed and the matter is remitted back to the file of the 2nd respondent to dispose of the same within a period of 1 month after giving due notice to the petitioner and affording an opportunity of personal hearing.
4. This writ petition is allowed with the above direction. Consequently, the connected miscellaneous petition is closed. No costs.
