ORDER

This Criminal Original Petition has been filed to register a case based on the petitioner's complaint dated 27.12.2021, pending on the file of the 4th respondent.

2.The grievance of the petitioner is that the petitioner had lodged a complaint on 27.12.2021, but no action has been taken. The petitioner is not aware about the stage of the complaint.

3.The learned Additional Public Prosecutor submits that the petitioner's complaint was earlier received in R.C.No.50/AC KBR/PG/2021 and RC.No.02/INS/K-10/PG/2021, another complaint was received in Rc.No.2512/COP/Visitors/2021. On receipt of the complaint of the petitioner, the 4th respondent had conducted enquiry, in which, both the petitioner and the counter complainants Rameshkumar and Rameshmurugan also appeared on 23.03.2021 to resolve the dispute between them and also sought some time for handing back the house. Hence, it was closed on 27.03.2021. With regard to the subsequent enquiry, both parties were enquired and it was found that the petitioner and the counter complainants are friends and they agreed to approach the Civil Court for their grievances and by report dated 13.01.2022, the same has been closed.

4. The learned counsel for the petitioner submits that the petitioner was not called for any enquiry and he had not given any letter of undertaking.

5. The learned Additional Public Prosecutor produced the letter of the petitioner, dated 13.01.2022.

6. In view of the same, the 4th respondent is directed to conduct fresh enquiry, calling the petitioner and the counter complainants in this case and to dispose of the petitioner's complaint and the outcome to be informed to the petitioner with acknowledgment. Accordingly, this criminal original petition is disposed of.
