..Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus to call for the records of the 2nd respondent made in RFL/Thirukazhukundram/26/2025 dated 21.11.2025 and quash the same as illegal, arbitrary and non-est in law, consequently direct the 2nd respondent to register the partition deed dated 21.11.2025 and release the same to the petitioner within the time stipulated by this Hon'ble Court.

ORDER

Tracing title from registered sale deed dated 07.05.1985 bearing document no.850/1985, the petitioner and his brother decided to partition properties relinquished under earlier partition deed bearing document no.3676/2006. When partition deed dated 21.11.2025 was presented for registration, the registering officer issued the impugned refusal check slip.

Adverting to earlier partition deed dated 23.03.2006, learned counsel for the petitioner submits that the parties thereto had relinquished their rights in the properties forming the subject of the present partition deed. Therefore, he submits that the impugned refusal order is liable to be set aside.

3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for both the respondents. Referring to the impugned refusal check slip, he submits that the order of refusal was issued because all the legal heirs of Kunavathi Ammal were not made parties thereto. In any event, in view of the submission that such persons relinquished their rights under partition deed bearing document no.3676/2006, he submits that the registering officer would reconsider the matter.

4. The impugned refusal check slip dated 21.11.2025 draws reference to partition deed bearing document no.3676/2006. The present partition deed makes express reference to the earlier partition deed and records that the parties thereto had relinquished their rights in respect of the properties forming the subject of the present partition deed. In view thereof, reconsideration is warranted. In order to enable the same, the impugned refusal check slip is set aside and the petitioner is permitted to re-present the partition deed for registration. Within thirty days from such re-presentation, subject to fulfilment of other requirements relating to registration, the registering officer shall either register the document if found to be in order or take such other action in accordance with law.
