Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondent to consider the representation given by the petitioner on 11.01.2017 for the post of Village Assistant under compassionate ground in Kanchipuram District.

By consent, the writ petition is taken up for final disposal. Mr.P.Senthilvel, learned Government Advocate accepts notice on behalf of the respondent.

The petitioner would claim that his father [late] M.Subiramani, S/o.Muthalu, was working in the cadre of Village Assistant [ePh; ghrd fhtyh;] at Singadivakkam Village, Kanchipuram Taluk and District and his appointment was confirmed vide proceedings of the Tahsildar, Kanchipuram dated 13.02.1992 in Na.Ka.No.2093/21.Aa3. The petitioner would further aver that his father died in harness on 22.02.1994, leaving behind the petitioner, his mother viz., S.Vijaya and grandparents. The petitioner was aged about 4 years at the time of his father's demise and the mother of the petitioner had prayed for compassionate ground appointment, vide application dated 29.03.1994. On behalf of the petitioner, who had attained majoirty during the year 2008, his mother submitted an application dated 11.06.2004 seeking appointment on compassionate ground and since the said application is yet to be disposed of, the petitioner came forward to file the present writ petition.

The learned counsel for the petitioner would submit that for want of compassionate ground appointment, the petitioner's family is suffering very much and prays for appropriate orders. Per contra, Mr.P.Senthilvel, learned Government Advocate appearing for the respondent has drawn the attention of this Court to the letter of the respondent dated 13.07.2012 in Na.Ka.No.15835/2012/A1 and would submit that for considering the request made by the petitioner, 19 documents have been directed to be furnished and as and when those documents are furnished, the request made by the petitioner will be considered.

The Court has considered the rival submissions and also perused the materials placed before it.

Though the petitioner has prayed for a larger relief, this Court, in the light of the facts and circumstances, permits the petitioner to respond to the communication of the respondent dated 13.07.2012 in

M.SATHYANARAYANAN, J., AP Na.Ka.No.15835/2012/A1 within a period of six weeks from the date of receipt of a copy of this order and upon receipt of the documents, the respondent is directed to consider the claim of the petitioner seeking compassionate ground appointment, on merits and in accordance with law and pass orders within a further period of ten weeks thereafter and communicate the decision taken, to the petitioner. The writ petition stands disposed of with the above direction. No costs.
