The matter is listed today under the caption "for being mentioned". 2.The learned counsel appearing for the petitioner would submit that the petitioner was granted bail by this Court in CRL.O.P.No.1793 of 2022 by order dated 28.01.2022 in which paragraph No.6 (a) the petitioner is directed to deposit one lakh and the same was permitted to withdraw by the defacto complainant without any undertaking clause. Hence, he prayed for suitable directions.
3. In view of the above submission so made by the learned counsel for the petitioner, this Court clarified that Paragraph No.6 (a) of the order dated 28.01.2022, passed in Crl.OP.No.1793 of 2022, shall be modified to the following effect:
'' 6 (a) the petitioner is directed to deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.1250 of 2021 before the learned Judicial Magistrate No.II, Chidambaram, Cuddalore 1/4
District, within a period of fifteen (15) days after lifting of lockdown or the commencement of the Court's normal functioning whichever is earlier and shall produce the said receipt before the Court below and the defacto complainant is permitted to withdraw the same with the undertaking affidavit to repay if the petitioner succeeds in this case and further two weeks time is extended to comply with the order.''
4. Accordingly, the Registry is directed to issue a fresh order copy in dated 28.01.2022 in Crl.O.P.No. 1793 of 2022 after making necessary corrections.
