Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to register the sale deed dated 11.01.2021 RFL/Joint Sub-Registrar-I Dharmapuri/04/2021 dated 11.01.2021 and return the same to the petitioner.

ORDER

The petitioner seeks a direction to the second respondent to register a sale deed executed on 11.01.2021. But, the second respondent insists on the production of the original title deed of the vendor.

2.The learned counsel for the petitioner submits that the original title deed is missing and could not be traced. But, the petitioner can produce the certified copy . 3.Mr.T.M.Pappiah, learned Special Government Pleader takes notice for the respondents and made a submission on instructions that the certified copy along with affidavit stating the inability of the petitioner to produce the original title deed may be filed before the second respondent. Whereupon, the second respondent would register the document. 4.The said statement of the learned Special Government Pleader is recorded.

5.The Writ petition is accordingly disposed of and the petitioner is now required to produce the certified copy of the title deed along with the affidavit as has been indicated by the learned Special Government Pleader within a period of two weeks from today (04.02.2021). Whereupon, the second respondent may register the sale deed, if it is otherwise in order, as per law and within a period of next 15 days. No costs.
