ORDER

The petitioner, who was arrested and remanded to judicial custody on 20.02.2025 for the alleged offence punishable under Section 5(m), 6(1) of

POCSO Act in Crime No.03 of 2025 on the file of the respondent police, seeks bail.

2. This Court earlier considered the bail application of the petitioner and dismissed the same on merits in Crl.O.P. No. 15017 of 2025 dated 12.06.2025. Now, the petitioner has approached this Court after examination of PW1 and seeks bail relying on the evidence of PW1.

3. Since the petitioner is seeking bail based on evidence recorded before the Trial Court, if the evidence is interpreted by this Court in this bail petition, it may cause prejudice to either side. To avoid this, I am of the view that the petitioner shall approach the Trial Court and seek bail on the same grounds. With this liberty, the petitioner is directed to approach the Trial Court and seek bail.
