J U D G M E N T

This Court has ordered notice to the appellants vide order dated 31.10.2023, since the learned counsel on record Mr.N.Mani passed away.

Notice sent to the first appellant was returned with an endorsement "deceased". Notice sent to the second appellant Mr.Mohanasundaram is served and his name is printed in the cause list. Further, the cause list also shows that in the notice board, R1 and R2 name affixed.

Despite the name of the second appellant is printed in the cause list, no one is appearing on his behalf. Hence, there is no purpose in keeping this second appeal pending on file.

In the result, this second appeal is dismissed for default. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
