This Civil Miscellaneous Petition has been filed seeking to condone the delay of 478 days in representing C.M.P. No. 7294 of 2024 in C.M.P.No.17949 of 2016 in S.A.SR.No. 77039 of 2016 of 2019.

2. Mr. L.Palanimuthu, learned counsel for petitioner/appellant submitted that the above petition was returned on 11.09.2020 for certain compliance and after taking the returns, the papers were misplaced with some other bundles. Hence, the petition was not represented in him. However, there is a delay of 478 days in representing the above said petition and the said delay caused neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable only. Accordingly, this Cour is inclined to allow this petition.
