The learned counsel representing the proposed fifth respondent states that the proposed fifth respondent is not the proper party, but the wife of the proposed fifth respondent is proper party.

In view of the statement made by the learned counsel for the proposed fifth respondent, the learned counsel for the petitioner seeks leave to withdraw this petition.

Leave as prayed for is granted and this petition is dismissed as withdrawn.
